Terms of Service

1. Scope of Creative Production

Neovis Studios (“the Studio”, “we”, “us”) provides performance concept creative production—including narrative scriptwriting, visual concept generation, hook variations, sound design, safe-zone captions, and testing matrices—for direct-to-consumer (DTC) brands.

Important Clarification: Neovis Studios provides concept creative assets only. We do NOT provide media buying, ad management, paid account management, creator whitelisting, or Spark Ads execution. The client is solely responsible for uploading, launching, and managing ad sets inside Meta Ads Manager or other ad networks.

2. Payment Terms & Production Kickoff

• Pre-Payment Required: All creative sprints—including the Single Concept Proof ($295), the 9-Cut Performance Creative Sprint ($750), and Monthly Refresh tiers (from $1,100/mo)—are fixed-price engagements paid in full before production starts.
• Start Condition: The 72-hour turnaround clock commences strictly after both (a) full payment has cleared and (b) all approved client inputs have been provided and confirmed in writing.
• Required Client Inputs: Client must provide an approved hero SKU, high-resolution physical pack shot(s), product factual specifications, approved marketing claims, audience angle, and confirmation of offer details.

3. Revision Policy & Scope Boundaries

To maintain 72-hour delivery velocity, sprints include one (1) consolidated revision round:

• All revision requests must be submitted in a single consolidated written batch within seven (7) business days of cut delivery.
• Permitted revisions include minor text corrections, caption timing tweaks, audio balance adjustments, and CTA card copy edits.
• Quoted Separately / Out of Scope: Requests for additional SKUs, new visual routes or concepts requested after route approval, second or subsequent revision rounds, raw unrendered project files, rush turnarounds, or custom celebrity likeness/voice modeling are outside standard sprint scope and will be quoted separately.

4. Client Warranties & Advertising Claims

The client represents and warrants that:

• All product specifications, claims, trademarks, logos, and materials supplied to Neovis Studios are accurate, legally substantiated, and owned or licensed by the client.
• All advertising claims comply with applicable regulatory bodies (including FTC, FDA, and local consumer protection regulations).
• Presenters in delivered cuts explain and demonstrate factual product features; they do not provide fabricated personal testimonials or unsubstantiated medical/financial claims.

5. Usage Rights & Licensing

Upon final delivery and receipt of payment:

• 90-Day Paid Meta Usage: Client receives a non-exclusive license to run the delivered vertical cuts as paid advertisements on Meta platforms (Instagram, Facebook) for a period of ninety (90) days from delivery.
• No Perpetual Rights by Default: Perpetual, global, broadcast, or out-of-home advertising rights are not included by default and require separate written agreement and rights clearance.
• Portfolio Showcase: Neovis Studios reserves the right to display the produced concept cuts in its portfolio and marketing reels unless an explicit NDA or embargo is agreed upon in writing prior to kickoff.

6. Limitation of Liability & No Performance Guarantees

Performance creative is designed for rigorous testing; however, ad performance depends on numerous external variables outside the Studio’s control—including product-market fit, pricing, offer appeal, landing page conversion rates, audience targeting, and ad platform algorithms.

NEOVIS STUDIOS MAKES NO GUARANTEE OF AD PERFORMANCE, RETURN ON AD SPEND (ROAS), COST PER ACQUISITION (CPA), CLICK-THROUGH RATES (CTR), OR SALES REVENUE.

In no event shall Neovis Studios’ total aggregate liability exceed the total fee paid by the client for the specific sprint giving rise to the claim.

7. Refunds & Cancellation

If, following review of your initial inputs, Neovis Studios determines that your product cannot be produced truthfully, accurately, or effectively within our craft standards, we will notify you before commencing work and refund your payment in full. Once scripts/routes are approved and generation has commenced, fees are non-refundable.
